These Terms of Use (the “Terms”) govern your access to and use of our app (“Swipelist” or the “App”), provided by Louis Delmas EI, including any services, features, and content made available through the App. By using Swipelist, you agree to these Terms. If you do not agree to these Terms, you may not use the App.

1. General Overview

Swipelist is an app to clear up your Spotify and Deezer playlist. Data can be transferred outside your device to our servers for authentication purpose, but no data is persisted. All API calls with Spotify and Deezer are made on your device.

2. Eligibility

To use Swipelist, you must:

• Be at least 4 years old or meet the minimum age required by the laws of your jurisdiction.
• Agree to comply with these Terms and any applicable laws, regulations, or guidelines.

If you are under the age of 18, you must have the permission of a parent or guardian to use the App.

3. Account Registration

No account is created on the app. We use anonymous identifier to provide services such as Swipelist+. You are responsible for safeguarding your Spotify and Deezer credentials. Swipelist is not responsible for any misuse of your Spotify or Deezer credentials, even if these misuses are related to Swipelist features (for example, removing a song from a playlist).

Signing out from the app removes your credentials from Swipelist local storage.

4. Use of the App

You acknowledge that you are solely responsible for any misuse made on your Spotify and Deezer account because of Swipelist usage or credentials stealing from Swipelist local storage.

5. Prohibited Activities

You agree not to:

• Use the App for any unlawful, harmful, or fraudulent activity.
• Attempt to reverse-engineer, copy, or tamper with the App’s code.
• Interfere with the operation of the App or the servers used to support it.

6. Intellectual Property

All content, features, and functionalities of Swipelist, including but not limited to the design, text, graphics, excluding playlist covers and song metadata that are property of streaming platforms and respective licensors, are the property of Louis Delmas EI or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7. Data Privacy

We collect, use, and store your data in accordance with our Privacy Policy.

All user data, including account information, is securely stored locally on your device which complies with industry standards for data protection and encryption.

You may submit requests related to your personal data, including those under the General Data Protection Regulation (GDPR), by contacting us at louis@delmaass.com.

8. Third-Party Services

Swipelist relies on external streaming services to provide features. While we strive to use reliable services, we cannot guarantee their performance or the accuracy of their outputs.

9. Disclaimer of Warranties

Swipelist is provided “as is” and “as available” without any warranties of any kind, whether express or implied. We do not guarantee that the App will meet your expectations or that it will be free from errors, interruptions, or security vulnerabilities.

10. Limitation of Liability

To the fullest extent permitted by law, Louis Delmas EI will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim will not exceed the amount you paid (if any) for using the App.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time for any reason, including violations of these Terms. Upon termination, your right to use the App will cease immediately.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be effective upon posting. Your continued use of the App after the changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
